Filing a Required Veterans Employment Report
Is a Precondition to Award fo a Defense Contract or Exercise of an Option

The requirement to file a VETS-100 report is imposed by the standard FAR Clause 52.222-37, which is generally a mandatory clause in contracts exceeding $10,000.  Holders of GSA Schedule contracts are also required to comply with the VETS 100 reporting requirement. 

Contractors which do not file a required Form VETS-100 are disqualified from receiving award of a Defense Department contract exceeding $100,000.  Further, a DoD contracting officer cannot exercise a contract option over this amount if the contractor in delinquent in filing this form.  This restriction became applicable March 11, 1998, via an interim rule issued by the Department of Defense (63 Fed. Reg.11850, March 11, 1998).  The restriction was imposed by Section 8117 of the National Defense Appropriations Act for Fiscal Year 1998 (Public Law 105-56).

The VETS-100 Form is due by March 31 for the preceding calendar year.
